Fort Wayne, IN—The United States Attorney's Office announced the following activity in federal court:
Kevin Porter, 53, of Fort Wayne, Indiana, was sentenced by Judge Theresa Springmann to 37 months imprisonment and 4 years of supervised release after pleading guilty to count one of an indictment charging him with conspiracy to distribute cocaine. This case was the result of an investigation by the Federal Bureau of Investigation Safe Streets Task Force. This case was prosecuted by Assistant United States Attorneys Anthony Geller and Tina Nommay.
Jeffrey Radabaugh, 41, of Monroeville, Indiana, was sentenced by Judge Theresa Springmann to 30 months imprisonment and 1 year of supervised release after pleading guilty to counts one and two of an Information charging him with filing a false tax return, and failure to file a tax return. This case was the result of an investigation by the Internal Revenue Service Criminal Investigation, and the Federal Bureau of Investigation. This case was prosecuted by Assistant United States Attorney Robert Trgovich.
Charles Dies, 53, of Fort Wayne, Indiana, pled guilty before Magistrate Judge Roger Cosbey to counts one and three of an indictment charging him with conspiracy to distribute cocaine, and possession with the intent to distribute cocaine in the case US v Hutchins et al. These charges were filed as the result of an investigation by the Federal Bureau of Investigation Safe Streets Task Force. This case is being prosecuted by Assistant United States Attorneys Anthony Geller and Tina Nommay.
Roberto Montemayor, Jr., 27, of Marion, Indiana, pled guilty before Magistrate Judge Roger Cosbey to count one of an indictment charging him with possession with the intent to distribute marijuana. These charges were filed as the result of an investigation by the U.S. Immigration and Customs Enforcement Office of Homeland Security Investigations, the Drug Enforcement Administration, the Indiana State Police, the JEAN Task Force, the Blackford County Sheriff’s Office, and the Marion Police Department. This case is being prosecuted by Assistant United States Attorney Anthony Geller.
Bryan Schlabach, 39, of Topeka, Indiana, was sentenced by Judge Theresa Springmann to 60 months imprisonment and 5 years of supervised release after pleading guilty to all counts of indictment charging him with distribution and production of child pornography, receipt of child pornography, and possession with the intent to view material containing visual depictions of child pornography that were transported in interstate commerce. This case was the result of an investigation by the Federal Bureau of Investigation, and the Queensland, Australia Police Service. This case was prosecuted by Assistant United States Attorney Lesley Miller Lowery.
The specific sentence in each case to be imposed upon conviction will be determined by the judge after a consideration of federal sentencing statutes and the Federal Sentencing Guidelines.
